1. Scope of Application, Definitions1.1 These General Terms and Conditions (GTC) apply to all services provided by the HUND dog club SB KG (“Provider”), in particular:
- dog daycare (08:00–17:00)
- dog hotel (including overnight care by a night nanny)
- grooming (care and styling services)
1.2 “Customer” means any natural or legal person who reserves or uses a service.
1.3 The applicable house rules, the privacy policy, as well as separate declarations of consent (in particular for emergency medical treatment and grooming) form an integral part of the contractual relationship.
2. Conclusion of Contract and Online Reservation2.1 Reservations may be made online, in writing (via email/form), or on-site.
2.2 An online reservation does not yet constitute a binding contract.
The contract is concluded only upon explicit booking confirmation by the provider.
2.3 Prior to submitting the online reservation, the consumer shall be provided with the legally required information pursuant to Section 4 FAGG (in particular service description, price, payment terms, cancellation policy, contract duration, and complaint procedure).
2.4 The provider is entitled to reject reservation requests without stating reasons prior to contract confirmation.
2.5 Payment shall be made exclusively on-site (cash or card payment). Online payment is not available.
3. Description of Services and Operational Organization3.1 Daycare: Care during the booked period within the opening hours (08:00–17:00).
3.2 Dog Hotel: Accommodation including overnight supervision by a night nanny in accordance with the operational concept.
3.3 Feeding: For daycare and hotel services, the customer must provide the dog’s food together with binding feeding instructions (amount, timing, special requirements). Without such instructions, no feeding will take place.
3.4 The provider is entitled, at its professional discretion, to care for dogs either in groups or individually.
4. Drop-off and Pick-up Times, Delay4.1 Drop-off and pick-up shall take place exclusively within the agreed time slots.
4.2 A delay shall be deemed to occur upon expiry of the agreed pick-up time.
4.3 In the event of delayed pick-up, an additional fee shall be charged in accordance with the applicable price list.
4.4 In cases of significant delay or if the owner cannot be reached, an additional care unit or an additional overnight stay may be charged in accordance with the price list.
5. Admission Requirements5.1 Only clinically healthy dogs without contagious diseases will be accepted.
5.2 A valid veterinary passport (vaccination record) is mandatory and must be presented at admission without request. Admission may be refused if the document is not provided. Only dogs with valid vaccinations against the following diseases are accepted:
- rabies
- canine distemper
- parvovirus
- leptospirosis
5.3 In the event of an acute parasite infestation, admission may be refused or necessary treatment may be arranged at the owner’s expense.
5.4 The following dogs will not be accepted:
- non-neutered male dogs
- females in heat
- aggressive or significantly uncontrollable dogs
5.5 A weight limit of 15 kg applies to daycare and hotel services.
6. Customer’s Duties to Cooperate6.1 The customer undertakes to provide complete and truthful information regarding:
- health condition
- vaccination status
- medication
- allergies
- behavioral issues
- biting incidents
- separation anxiety
6.2 The customer shall provide food, feeding instructions, as well as any required medication together with dosage instructions.
6.3 The customer must ensure to be reachable during the period of care or designate an emergency contact person who can be reached during that time.
7. Prices, Payment, Default7.1 The prices published at the time of booking shall apply.
7.2 Advance payments may be required.
7.3 In the event of payment default, statutory default interest pursuant to Section 1000 ABGB shall apply.
7.4 The provider is entitled to exercise a right of retention until all due and undisputed claims have been settled in full.
8. Cancellation and No-Show8.1 Cancellation free of charge is possible no later than 24 hours before the start of the service.
8.2 In the event of cancellation less than 24 hours before the start of the service or in case of no-show, a lump-sum cancellation fee of up to 100% of the agreed remuneration shall be charged.
8.3 The lump sum is objectively justified, as the services are scheduled for fixed dates and times (fixed appointments) and staff as well as capacity are reserved on a binding basis.
8.4 The customer retains the right to prove that the actual damage incurred was lower. The provider retains the right to prove that the actual damage incurred was higher.
9. Termination for Good CauseThe provider is entitled to terminate the care services with immediate effect if:
- a risk or danger exists,
- material information has been withheld,
- the dog is not manageable,
- an illness is suspected.
Costs already incurred shall remain payable.
10. Liability10.1 The provider shall have unlimited liability for personal injury.
10.2 For other damages, the provider shall be liable in cases of intent and gross negligence.
10.3 In cases of slight negligence, the provider shall be liable only for the breach of essential contractual obligations and limited to the foreseeable damage.
10.4 Liability for damage “caused by an animal” shall be governed by Section 1320 ABGB and depends primarily on custody, supervision, and the specific circumstances of the individual case.
10.5 Typical risks associated with group care (e.g., minor injuries resulting from play behavior, stress reactions) cannot be completely excluded even with professional supervision.
11. Overnight Care11.1 Overnight supervision is provided by a night nanny in accordance with the operational concept.
11.2 Continuous one-to-one monitoring of each individual dog is not owed unless separately agreed.
11.3 If the owner cannot be reached in an emergency, the provider is entitled to take necessary measures at its due discretion (in particular to consult a veterinarian).
11.4 If a dog is not collected on time and the owner cannot be reached, the provider is entitled to continue the care and charge the resulting costs.
12. Veterinary Emergencies12.1 The provider is entitled to immediately consult a veterinarian in the event of a medical emergency.
12.2 The customer grants consent thereto by signing a separate declaration of consent.
12.3 All costs arising therefrom shall be borne by the customer.
13. Grooming13.1 Grooming services are provided on the basis of a separate declaration of consent.
13.2 In cases of severe matting, a shorter clip may be performed for animal welfare reasons.
13.3 The provider is entitled to take safety measures or to discontinue the treatment.
14. InsuranceThe provider maintains a valid business liability insurance policy covering risks associated with animal care.
The customer is recommended to maintain a valid dog owner’s liability insurance policy.
15. Photo and Video Recordings15.1 Photo or video recordings for marketing purposes shall be made exclusively on the basis of a separate explicit consent.
15.2 Independently thereof, the provider is entitled to make recordings for internal documentation purposes (e.g., condition of the coat, injuries, care documentation), insofar as this is necessary for contract performance or for evidentiary purposes.
16. Data ProtectionThe processing of personal data is carried out in accordance with the GDPR and the Austrian Data Protection Act (DSG).

17. Right of Withdrawal (Consumers)The provisions of the Austrian Distance and Off-Premises Contracts Act (FAGG) shall apply to consumers.
For services provided at a specific point in time or within a clearly defined period (fixed appointments), no right of withdrawal may exist pursuant to Section 18 (1) no. 10 FAGG.
18. Applicable Law and JurisdictionAustrian law shall apply.
For entrepreneurs, the place of jurisdiction shall be Vienna.
For consumers, the statutory place of jurisdiction shall apply.
19. Severability ClauseShould any provision of these General Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
